This firm's predecessor was Malloy & Malloy, Inc. which was formed in 1972 by Pat Malloy Jr. and his son, Patrick J. Malloy III. Malloy Law Firm was formed by Patrick J. Malloy III after the death of Pat Malloy Jr. in January 2004.

Patrick J. Malloy III has been in the practice of law since 1972. He has been a Panel Bankruptcy Trustee since that date. As Trustee, he has handled several thousands of cases. Some of the major cases administered were:


In re William Bartmann

Recovered approximately $6 million in unencumbered assets; resolved over $1.5 billion in unliquidated claims against the estate involving over 300 separate claimants by settling Trustee's subordination claim against these parties based upon a percentage distribution of the monies on hand.

In re Universal Factoring

Recovered approximately $1.5 million in fraudulent transfers in this Ponzi scheme matter.

In re Great Plains Airlines

Served as both trustee and counsel for the trustee in this matter involving a defunct local airline; recovered several millions of dollars primarily through litigation including claims against former officers and directors.

In re 4 Front Petroleum

Served as both Trustee and counsel for the trustee. Recovered several millions of dollars from claims pursued against former control persons of a sister corporation based upon fraudulent acquisition of fuel on the eve of bankruptcy.

In re Lexington Oil and Gas

Served as counsel for the trustee in this matter and recovered $1.5 million after trial to the court in a matter involving re-characterization of initial contributions as capital rather debt and a related fraudulent transfer claim.

In re Arrow Trucking

Served as both trustee and counsel for the trustee; case was a highly publicized case involving one of the largest trucking companies in the country; recovered in excess of $6 million and paid all employees priority wage and WARN act claims in full within approximately two years of appointment.

In re Penloyd

Served as both trustee and counsel for the trustee; recovered $2.5 million from prosecution of fraudulent divident claim. 

In re David Gordon

Served as Trustee and attorney for the Trustee in this case involving a debtor who was convicted of a pre-petition pump and dump stock scheme. Acting as attorney for the Trustee, recovered $2.8 million from prosecution of certain fraudulent transfers and claims against third parties who aided and abetted the debtor’s scheme. The case also involved the unique issue of creditors assigning claims to a bankruptcy estate. 


 

He has also been involved in significant Chapter 11 cases including In re Interchange which involved court approval of a plan of reorganization in a matter involving the cram down of the proposed treatment of the RTC's $8 million claim.

He has also participated in jury trials of wrongful termination cases which have resulted in affirmed jury verdicts of in excess of $5,000,000. Some of the major cases were:


Cook, Lewis, and Miller v. Northrop Worldwide Aircraft Services Inc.
 

Represented the plaintiffs in this wrongful termination claim in violation of the public policies of the State of Oklahoma; jury verdict; recovery was approximately $2.5 million.

Marshall v. TRW Inc. 900 F2d 1517 (10th Cir. 1990)

Represented the plaintiff in this claim for wrongful termination in violation of the workers compensation laws of the State of Oklahoma; jury verdict; recovery approximately $350,000.

Mantha v. Liquid Carbonics, 839 P2d 200 (Okla. App. 1992)

Represented the plaintiff in this claim for wrongful termination in violation of the workers compensation laws of the State of Oklahoma; jury verdict; recovery of approximately $400,000.

Larry Griffaw v. ITT Services 

Represented the plaintiff in this claim for wrongful termination in violation of the public policies of the State of Oklahoma; jury verdict; recovery of approximately $350,000.
